The Justice Department has found Marilyn Mosby, the former chief prosecutor in Baltimore who gained notoriety for her role in the Freddie Gray case, guilty on two charges of perjury. The charges are related to claims that Mosby falsified information on loan applications for two vacation houses in Florida, taking advantage of a CARES Act provision intended for individuals experiencing financial difficulties as a result of the COVID-19 outbreak.

Mosby, who is suspected of seeking loans in order to take money out of her retirement accounts, has entered a not guilty plea to two counts of perjury and two counts of making false statements. She could get a maximum term of five years in jail if found guilty of each count of perjury.

Mosby is accused of filing fraudulent mortgage applications for the vacation properties in a different federal lawsuit, in addition to the perjury charges. There is currently no scheduled date for the separate trial for these charges.

The federal indictment, which was released in January 2022, claims that Mosby concealed a gross salary of $247,955.58 that was fixed in 2020 from the loan application, misrepresenting her financial circumstances. She also allegedly withheld information about a $45,000 federal back tax liability. According to the indictment, Mosby had already signed a rental agreement with a management company, but she allegedly falsely claimed to be the primary occupant of one of the residences in order to obtain a reduced interest rate. Notably, she made a profit of $150,000 when she sold one of the properties.

Mosby has insisted on her innocence despite the accusations, calling the court case against her a “political ploy.” Mosby’s prior prominent position as Baltimore’s chief prosecutor and her involvement in the Freddie Gray case—in which she charged six police officers in connection with Gray’s 2015 death—have brought attention to the case.
